2. Definitions

• “Host” means a user who creates and manages an event on the Service.

• “Guest” means a person who accesses an event via a link or QR code and may upload, view, or download content without creating an account.

• “Event” means a Host-created space used to collect, review, display, and share content.

• “User Content” means all content uploaded or submitted through the Service, including photos, videos, and messages rendered into images.

• “Plan” means a one-time, event-based purchase (Free, Silver, or Gold) with specific features and retention periods.

3. Eligibility

You must be at least 13 years old to use the Service.

If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian.

Hosts represent that they have the authority to create and manage Events and to collect and share User Content in compliance with these Terms and applicable laws.

4. Accounts and access

4.1 Host accounts

Hosts must create an account to create and manage Events. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

4.2 Guest access (no registration)

Guests may access Events via a link or QR code without creating an account. Guests are responsible for any User Content they upload and must comply with these Terms.

4.3 Collaborators

Hosts may invite collaborators to assist with Event management. Hosts remain responsible for all actions taken by collaborators within the Event.

5. Acceptable use

You agree not to upload, share, or otherwise use the Service to:

• Violate any applicable law or regulation

• Infringe intellectual property, privacy, or publicity rights

• Upload content you do not own or have permission to share

• Upload content that is illegal, abusive, hateful, defamatory, or harmful

• Upload sexually explicit content involving minors (strictly prohibited)

• Distribute malware, spam, or attempt unauthorized access

• Interfere with or disrupt the Service

We reserve the right to remove content, disable links, or suspend Events that violate these Terms or applicable law.

6. User Content

6.1 Ownership

You retain ownership of your User Content. Myotrix AS does not claim ownership of User Content.

6.2 License to operate the Service

By uploading User Content, you grant Myotrix AS a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, display, and distribute such content solely for the purpose of operating and providing the Service, including:

• displaying content in albums or slideshows

• enabling downloads where permitted

• generating previews or thumbnails

• storing content during the applicable retention period

This license ends when the content is deleted, subject to backup and legal retention obligations.

6.3 Host responsibility

Hosts are responsible for ensuring they have obtained all necessary rights and consents from Guests and other participants, including consent to collect, display, download, and share content.

6.4 Guest responsibility

Guests represent that they have all necessary rights and permissions to upload their User Content and that doing so does not violate any law or third-party rights.

7. Event permissions and moderation

Hosts control Event permissions, including whether Guests may:

• upload content

• view content

• download content

• appear in live slideshows

Access is granted to anyone who has the Event link or QR code, subject to the permissions enabled by the Host.
Hosts may review, approve, hide, or remove content depending on Event settings. Myotrix AS may remove content or restrict access where required by law or these Terms.

8. Retention, storage, and deletion

User Content is stored according to the Event’s Plan:

• Free Plan: 7 days

• Silver Plan: 30 days

• Gold Plan: 90 days

After the retention period expires, Events and associated User Content may be permanently deleted.
Deletion may not be immediate from backups or logs, but will occur within a commercially reasonable time unless retention is required by law.

9. Payments and billing

9.1 One-time event purchases

All purchases are event-based, one-time payments. There are no subscriptions.

9.2 Payment processing

Payments are processed by Paddle, which acts as the merchant of record. Billing is subject to Paddle’s terms and policies in addition to these Terms.

9.3 Pricing and taxes

Prices may vary by market and currency. Applicable taxes (such as VAT) will be calculated and displayed at checkout where required.

9.4 Refunds

Refund eligibility depends on the Plan purchased, timing, usage, and applicable consumer protection laws. Where required by law, mandatory refunds will be honored.

10. Intellectual property

All software, branding, designs, trademarks, and technology used in the Service are owned by Myotrix AS or its licensors. You may not copy, modify, distribute, reverse engineer, or exploit the Service except as permitted by law.

11. Third-party services

The Service may rely on third-party services (e.g., hosting, analytics, payment providers). Myotrix AS is not responsible for third-party services or their availability.

12. Privacy and data protection

Personal data is processed in accordance with our Privacy Policy.
Hosts acknowledge that they may act as a data controller for User Content collected from Guests and are responsible for compliance with applicable data protection laws, including GDPR.

13. Disclaimer of warranties

The Service is provided “as is” and “as available.”
‍To the fullest extent permitted by law, Myotrix AS disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.We do not guarantee uninterrupted availability, error-free operation, or permanent storage beyond stated retention periods.

14. Limitation of liability

To the fullest extent permitted by law, Myotrix AS shall not be liable for indirect, incidental, consequential, or special damages, including loss of data, revenue, or goodwill.
Myotrix AS’s total liability shall not exceed the greater of the amount paid by you for the relevant Event.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Myotrix AS from any claims, damages, losses, and expenses arising from:

• your use of the Service

• your User Content

• your violation of these Terms or applicable law

• infringement of third-party rights

16. Suspension and termination

We may suspend or terminate access to the Service if:

• these Terms are violated

• required by law

• necessary to protect the Service or other users

17. Changes to the Service or Terms

We may update the Service or these Terms from time to time. Material changes will be communicated via the Service or email. Continued use after changes take effect constitutes acceptance.

18. Governing law and jurisdiction

These Terms are governed by the laws of Norway, without regard to conflict-of-law principles.
Any disputes arising out of or relating to the Service shall be subject to the exclusive jurisdiction of the courts of Norway.
